Please read this document carefully it contains very important information about your rights and obligations, as well as limitations and exclusions that may apply to you.

Agreement Between You (Customer) and FlyExpert

Welcome to the flyexpert.com website (the “Website” or “Site”). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel – related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes. The terms “we”, “us”, “our”, “FlyExpert” refer to a travel agency focusing on the sale of business class air travel to corporate and high-end leisure customers. The term “you” refers to the customer visiting the Website and/or booking a reservation through our customer service agents.

Disputes. The exclusive means of resolving any dispute or claim arising out of or relating to this Agreement (including any alleged breach thereof), the Service, or the Website shall be BINDING ARBITRATION administered by the American Arbitration Association. The one exception to the exclusivity of arbitration is that you have the right to bring an individual claim against the Company in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against the Company any class action, class arbitration, or other representative action or proceeding. By using the Website or the Service in any manner, you agree to the above arbitration agreement. In doing so, YOU GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend any claims between you and the Company (except for matters that may be taken to small-claims court). YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER CLASS PROCEEDING. Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons. Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against the Company (except for small-claims court actions) may be commenced only in the federal or state courts located in San Francisco, California. You hereby irrevocably consent to the jurisdiction of those courts for such purposes. This Agreement, and any dispute between you and the Company, shall be governed by the laws of the state of California without regard to principles of conflicts of law, provided that this arbitration agreement shall be governed by the Federal Arbitration Act. You can decline this agreement to arbitrate by filling out an arbitration opt out letter and sending it to our email [email protected] within 30 days of first accepting these Terms & Conditions.

This Website is offered to you considering conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the “Terms & Conditions” or “Agreement”), which may be revised when it is necessary. Please read these Terms & Conditions carefully, as they contain important information about limitations of liability and the resolution of disputes through arbitration rather than in court. You should also read our Privacy Policy, which also governs your use of the Website. By accessing or using this Website or contacting our agents, you agree that the Terms & Conditions then in force shall apply. If you do not agree to the Terms & Conditions, please do not use this Website, book any reservations or apply for any of our services through our agents.

Under this agreement, the payment processing services for goods and/or services purchased on this website are provided by FlyExpert on behalf of the airlines depending on the type of payment method used and on the type of services and goods.

Use of the Website

As a condition of your use of this Website, you warrant that:

  1. you are at least 18 years of age;
  2. you possess the legal authority to create a binding legal obligation;
  3. you will use this Website in accordance with these Terms & Conditions;
  4. you will only use this Website services to make legitimate reservations for you or for another person for whom you are legally authorized to act;
  5. you will inform such other persons about the Terms & Conditions that apply to the reservations/services you have made/ordered on their behalf, including all rules and restrictions applicable thereto;
  6. all information supplied by you is true, accurate, current, and complete.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms & Conditions.

General Rules and Conditions

Conditions

These tickets cannot be rerouted or transferred. Name changes on tickets are not allowed – only the original passenger can use the ticket(s). Take special note that airline tickets and hotel accommodations and all service fees may not be refundable. If fare rules allow refunds and/or exchanges, a $250.00 (per person) processing fee will be charged in addition to any applicable fees charged by the carrier/provider upon cancellation/exchange. Fees will vary depending on the provider’s terms and conditions. You will not receive a monetary refund when canceling. Instead, you will receive a credit (minus any airline or hotel fees) towards a future ticket purchase with FlyExpert for long-haul international flights of equal or greater value, which will be valid for up to twelve (12) months from the original date of purchase. No-Show tickets cannot be refunded, nor can they be exchanged. Unless the reservation is canceled and the trip rescheduled prior to the original departure date, the ticket is suspended and refunds are not possible. Please check your e-mail frequently for any schedule change notifications from the airline and verify the current flight information 72 hours prior to scheduled departure. Failure to use any reservation will result in an automatic cancellation of all continuing and return flight reservations and suspension of the tickets. The ticket can be used only in the sequence it was issued. Out-of-sequence usage is not allowed. The recommended check-in time for all international flights is minimum 3 hours before departure time, even if you are traveling on a domestic flight to another airport to connect to your international flight. Airline tickets are subject to the published conditions of carriage and rules, including but not limited to, the cancellation policies of the applicable airline. The contract of carriage in use by the applicable airline, when issued, shall be between the applicable airline and the passenger. Airlines retain the right to adjust flight times and schedules at any time – schedule changes can result in an itinerary that falls outside of contractual agreements. Airlines may also in their discretion change or cancel flights or itineraries. FlyExpert is not responsible for schedule changes. If your ticket is not honored for any reason, please contact your agent immediately. Your ticket is guaranteed up to the amount paid for the ticket, and FlyExpert will replace your ticket within 24 hours or offer a full refund, or provide other alternative options within 24 hours. Please read important information regarding airline liability limitations. All tickets validity is 1 year after they are issued. If tickets are not used within this period their value is lost. Travel Care Service fees are non-refundable.

Baggage Allowance

Travelers may have to pay additional fees at the airport if their checked items exceed the weight, size or number spelled out in the standard baggage allowance of the airline. Some airlines do not offer any free baggage allowance. Baggage allowance policies and baggage fees associated with checked or carry-on baggage vary widely and are subject to change by the airlines at any time.

Frequent Traveler Points

You acknowledge and explicitly authorize an agent to create a frequent flyer account on your behalf using your name and personal information to assist in booking award tickets. You also acknowledge and agree that the frequent flyer account will be managed by the agent and that account details may be subject to change. If you detect any errors in your account details, please inform your agent immediately. Passengers cannot accrue mileage on award travel. Frequent traveler rewards (such as miles, points, etc.), upgrades, certificate vouchers, and other discounts or incentives may not be applicable to FlyExpert flights, hotel stays, or other travel services. Additionally, mileage accrual may not be available for all tickets. Please consult with your agent for more information.

Supplier Rules and Restrictions

Additional terms and conditions will apply to your reservation and purchase of travel-related goods and services from both airline and hotel providers. Please carefully review these terms and conditions on the respective websites of the airline, hotel, or other accommodation providers. By proceeding, you agree to comply with the terms and conditions set forth by any supplier with whom you choose to engage, including, but not limited to, the timely payment of all amounts due and adherence to the supplier’s rules and restrictions regarding the availability and use of fares, products, or services. We reserve the right to cancel your booking if full payment is not received promptly. Some airline or hotel providers may require a credit card or cash deposit upon check-in to cover any additional expenses incurred during your stay. This deposit is separate from any payment made to FlyExpert for your booking. You acknowledge that certain third-party providers offering specific services and/or activities may require you to sign a liability waiver before participating in the services and/or activities they provide. You understand that any violation of the supplier’s rules and restrictions may result in the cancellation of your reservation(s), denial of access to the relevant travel products or services, forfeiture of any payments made, and/or charges to your account for any costs incurred by us as a result of such violations. Please note that you will not earn miles or points for this ticket/tickets.

Travel Destinations and Visa Requirements

International travel requires that passengers have in possession a valid Passport, which must be presented for all international flights. Please note that some countries may require a visa and/or a health card. It is the passenger’s responsibility to have all required travel documents in possession at check-in. It is strongly recommended that passengers review visa requirements for all stops as some countries may require a transit visa. Passengers transiting via or connecting between airports located in the European Union – Schengen Zone may need a Schengen Entry visa. Please contact the embassy of the country you are going to visit or transit through to get the up-to-date requirements. Some countries have special requirements for one way travel – it is travelers’ responsibility to make sure they meet eligibility criteria for one way travel. Visa information is also available at the Travel Advisory Section of the U.S. State Department (phone line: 202-647-5225, official website: https://www.state.gov/). Holders of non-U.S. passports are advised to contact the embassies of their destination and transit countries to obtain entrance requirements. Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. FlyExpert urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at https://www.state.gov/https://www.tsa.gov/https://www.transportation.gov/https://www.faa.gov/https://www.cdc.gov/, and https://www.treasury.gov/resource-center/sanctions/Pages/default.aspx. By offering for sale travel to particular international destinations, FlyExpert.com does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.

Ticket Delivery

All the tickets sold by FlyExpert are electronic tickets (e-Tickets) and will be sent to the email address provided by you during the booking. Once your electronic tickets are issued, you will receive an email confirmation which will include the ticket number, and the reservation numbers for each airline you’ll be traveling on.

Payment Information

FlyExpert uses stringent safety measures for credit card payment processing. We accept all major credit cards: Visa, MasterCard, American Express, Diners Club, Discover. Credit card transactions are authorized at the time you or anyone acting on your behalf accepts these Terms & Conditions and continues with the purchase. All credit cards must have a verifiable US, Canadian, UK, Australian, Singapore or other country billing address. When certain transactions are determined to be high risk by our systems, we will not process such transactions unless our credit card verification team has determined that its safe to process them. In order to establish validity of such transactions, we may contact you or your bank. Fraudulent transactions, if any, are reported to airport security, airlines and other federal and state law enforcement. Most credit card transactions over the phone to our Client Service Department are recorded and are available as evidence in case of any dispute. If your credit card is declined for any reason, we will notify you within 24 hours. Simply submitting the credit card does not automatically guarantee ticketing. All bookings and fares are not guaranteed until ticketed by the supplier. Some banks and credit card companies impose fees for international transactions. Your bank may convert the payment amount to your local currency and charge a conversion fee. As a result, the amount displayed on your credit or bank card statement may be in your local currency and may differ from the amount shown on the billing summary page for a reservation made on the Website. Additionally, a foreign transaction fee may be applied if the bank that issued your credit card is located outside the United States. Booking international travel might be treated as an international transaction by your bank or card company, especially since FlyExpert may remit payment to an international travel supplier. The currency exchange rate and any foreign transaction fees are determined solely by your bank on the date they process the transaction. If you have questions about these fees or the exchange rate applied to your booking, please contact your bank directly. I acknowledge that FlyExpert may conduct a credit card verification to prevent fraud, which may include: (1) a temporary authorization charge of less than $2 that will be canceled afterward, (2) contacting the bank or card issuer, (3) a conference call involving FlyExpert and bank representatives, and/or (4) requesting proof that the cardholder, with a valid ID, is the legitimate owner of the credit card provided to FlyExpert. If your credit card is declined for any reason, we will inform you within 24 hours. Please note that submitting your credit card information (along with other reservation details) does not guarantee ticketing.

Service Appreciation

If the customer is satisfied with the service provided by our agent, they may opt to add an additional amount to their purchase as a token of appreciation. This additional amount is non-refundable.

Vouchers

We may periodically issue vouchers to our customers as a promotional offer or as an acknowledgment of their cooperation with us. Vouchers may also be provided as part of a separate Travel Product. Customers can use a voucher to purchase a ticket by applying the voucher amount towards the ticket price. Please note that only one voucher can be used per ticket purchase. The specific terms and conditions of each voucher, including its validity period and transferability, are indicated on the voucher itself and will be available for review prior to the customer’s acceptance and receipt.

Minor Travel

A minor is defined as anyone 17 years old or younger. The rules for minor travel vary by airline, but generally:

  1. Minors under 5 years of age are not permitted to travel without an accompanying adult.
  2. Minors aged 5-14 years may travel alone if they utilize the airline’s mandatory unaccompanied minor service.
  3. For minors aged 15-17 years, the unaccompanied minor service is typically optional.

We strongly recommend that you verify the specific requirements for minor travel directly with the airlines well in advance, and certainly before purchasing a ticket for a minor with FlyExpert. FlyExpert is not responsible for any denied boarding of a minor due to the failure to meet the airline’s requirements. Please note the following:

  • If a child requires an unaccompanied minor service, additional airline fees may apply, and this service must be arranged directly with the airline before the minor’s travel.
  • The unaccompanied minor service may not be available on all flights. For example, depending on the child’s age, some airlines may require nonstop flights for unaccompanied minors.
  • Guardian contact information is typically required for unaccompanied minors.
  • Minors under the age of 17 who are flying alone on international flights may need to provide a signed letter of consent from a parent or responsible adult.

When booking travel for a minor with FlyExpert, you warrant that:

  • You have the full legal authority to create a binding legal obligation and purchase a ticket for the minor, either as their parent/legal guardian or otherwise.
  • You have verified the travel requirements for minors with the relevant airline in advance and fully understand and agree to comply with them to ensure the minor’s travel with the airline.

These Terms & Conditions apply to the booking of travel for a minor with FlyExpert without any exceptions and are subject to the above provisions. If you need any further adjustments or have any questions, feel free to ask!

Limitations of Liability

The information provided on this website (including text, graphics, links, or other material) is available on an “as is” and “where available” basis. FlyExpert makes no representations or warranties, either express or implied, to you or any other individual or entity regarding the accuracy, results, timeliness, completeness, merchantability, or fitness for a particular purpose of the website or any related materials, products, services, or information. This includes, but is not limited to, warranties arising by statute or otherwise in law or from a course of dealing or usage of trade. Under no circumstances, including negligence, shall we, our providers, or distributors be liable for any damages to, or viruses that may infect, your computer equipment or other property, or any loss of data resulting from your access to, use of, or browsing on the website, or from downloading any materials, data, text, images, video, audio, or other information from the website or from any email or links sent to you by FlyExpert. We, our providers, or distributors shall not be liable for any injury, loss, claim, damage, or any special, punitive, exemplary, direct, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits, lost business, or lost savings), whether based in contract, tort, strict liability, or otherwise, arising out of or in any way connected with the use or inability to use the website, the services or materials on the website, or the travel reservations booked through FlyExpert’s call center, even if advised of the possibility of such damages. In no event shall our total liability, or that of our providers or distributors, exceed the total charges listed in the itinerary that gave rise to such liability. Any claim or cause of action arising from, or relating to, your access to and use of, or purchase of products and/or services from, the website must be filed within one hundred and eighty (180) days from the date on which such claim or action arose or the purchase was completed. Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. Your use of the website is at your own risk. We act as an intermediary or agent for providers of travel-related products and/or services by promoting, selling, or accepting reservations or bookings for such products and/or services (such as air transportation, hotel accommodations, meals, travel insurance, etc.) and are not liable for the products and services provided by these suppliers. The carriers, hotels, and other suppliers offering travel or related services on this website are independent contractors and are not agents or employees of the company or its affiliates. The company and its affiliates are not responsible for the actions, errors, omissions, representations, warranties, breaches, or negligence of any such suppliers, nor for any personal injuries, death, property damage, or other damages or expenses resulting from their actions. The company and its affiliates bear no liability and will not provide refunds in the event of delays, cancellations, overbookings, strikes, force majeure, or other events beyond their direct control. They also have no responsibility for any additional expenses, omissions, delays, rerouting, or actions taken by any government or authority. By using the Website, you irrevocably waive any claim against FlyExpert, its subsidiaries, affiliates, and any of their officers, directors, managers, agents, contractors, or employees. You expressly agree that neither FlyExpert nor any of its subsidiaries, affiliates, officers, directors, managers, agents, contractors, or employees shall be held liable for:

  • Any loss of or damage to property, or injury to any person, caused by any defect, negligence, or other wrongful act or omission, or any failure of performance by any Travel Supplier.
  • Any inconvenience, loss of enjoyment, mental distress, or similar issues.
  • Any delays in departure, missed connections, substitutions of accommodations, terminations of service, or changes in fares and rates.
  • Any cancellation or double-booking of reservations or tickets beyond FlyExpert’s reasonable control.
  • Any claim arising out of or in connection with air or other transportation services, products, or features performed or not performed, or occurring or not occurring, in connection with your itinerary.

For clarity (and without limiting the foregoing), FlyExpert assumes no liability for canceled flights, missed flights, or flights not connecting due to schedule changes made by the relevant airline. The limitations outlined in these Terms & Conditions shall remain in effect and apply even if any limited remedy specified in these Terms & Conditions is deemed to have failed in its essential purpose. The limitations of liability provided in these Terms & Conditions benefit FlyExpert, its affiliates, and the suppliers of travel products and services purchased through our Website.

Indemnification

You agree to protect and indemnify FlyExpert, its affiliates, partners, joint ventures and/or their respective suppliers and any of their respective officers, directors, managers, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by:

  • you or on your behalf in excess of the liability described above;
  • by third parties as a result of your breach of these Terms & Conditions, notices or documents referenced on the Website;
  • your violation of any law or the rights of a third party; or
  • your use of the Website.

Warsaw Convention and Montreal Convention

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of departure are advised that international treaties known as the Montreal Convention, or its predecessor, the Warsaw Convention, including its amendments (the Warsaw Convention system), may apply to the entire journey, including any portion thereof within a country. For such passengers, the applicable treaty, including special contracts of carriage embodied in any applicable tariffs, governs and may limit the liability of the carrier.

Notice of Liability Limitations

The Montreal Convention or the Warsaw Convention system may be applicable to your journey and these Conventions govern and may limit the liability of air carriers for death or bodily injury, for loss of or damage to baggage, and for delay. Where the Montreal Convention applies, the limits of liability are as follows: There are no financial limits in respect of death or bodily injury. In respect of destruction, loss of, or damage or delay to baggage, 1,100 Special Drawing Rights (approximately EUR 1,300; US $1,700) per passenger in most cases. For damage occasioned by delay to your journey, 4,694 Special Drawing Rights (approximately EUR 5,400; US $7,100) per passenger in most cases EC Regulation No. 889/2002 requires European Community carriers to apply the provisions of the Montreal Convention limits to all carriage by them of passengers and their baggage by air. Many non-European Community carriers have elected to do so in respect of the carriage of passengers and their baggage. Where the Warsaw Convention system applies, the following limits of liability may apply: 16,600 Special Drawing Rights (approximately EUR 20,000; US $20,000) in respect of death or bodily injury if the Hague Protocol to the Convention applies, or 8,300 Special Drawing Rights (approximately EUR 10,000; US $10,000) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits in their entirety, and US regulations require that, for journeys to, from or with an agreed stopping place in the US, the limit may not be less than US $75,000. 17 Special Drawing Rights (approximately EUR 20; US $20) per kg for loss of or damage or delay to checked baggage, and 332 Special Drawing Rights (approximately EUR 400; US $400) for unchecked baggage. The carrier may also be liable for damage occasioned by delay. Further information may be obtained from the carrier as to the limits applicable to your journey. If your journey involves carriage by different carriers, you should contact each carrier for information on the applicable limits of liability. Regardless of which Convention applies to your journey, you may benefit from a higher limit of liability for loss of, damage or delay to baggage by making at check-in a special declaration of the value of your baggage and paying any supplementary fee that may apply. Alternatively, if the value of your baggage exceeds the applicable limit of liability, you should fully insure it before you travel. Time limit for action: Baggage claims: Written notice to the carrier must be made within 7 days of the receipt of checked baggage in the case of damage, and, in the case of delay, within 21 days from the date on which it was placed at the disposal of the passenger.

Notice of Contract Terms Incorporated by Reference

  1. Your contract of carriage with the carrier that provides you with carriage by air, whether international, domestic or a domestic portion of an international journey is subject to this notice; to any notice or receipt of the carrier; and to the carrier’s individual terms and conditions (Conditions), related rules, regulations and policies (Regulations) and any applicable tariffs.
  2. If your carriage is by more than one carrier, different Conditions, Regulations and any applicable tariffs may apply for each carrier.
  3. The Conditions, Regulations and any applicable tariffs of each carrier are, by this notice, incorporated by reference into and made part of your contract of carriage.
  4. The Conditions may include, but are not restricted to:
    4.1. Conditions and limits on the carrier’s liability for the bodily injury or death of passengers.
    4.2. Conditions and limits on the carrier’s liability for the loss of, damage to or delay of goods and baggage, including fragile or perishable goods.
    4.3. Rules for declaring a higher value for baggage and for paying any supplementary fee that may apply.
    4.4. Application of the carrier’s Conditions and limits of liability to the acts of the carrier’s agents, servants and representatives, including any person providing either equipment or services to the carrier.
    4.5. Claims restrictions, including time limits by which passengers must file claims or bring actions against the carrier.
    4.6. Rules about reconfirmations or reservations; check in times; the use, duration and validity of air transportation services; and the carrier’s right to refuse carriage.
    4.7. Rights of the carrier and limits on the carrier’s liability for delay or failure to perform a service, including schedule changes, substitution of alternative carriers or aircraft and re-routing, and, when required by applicable law, the obligation of the carrier to notify passengers of the identity of the operating carrier or substituted aircraft.
    4.8. Rights of the carrier to refuse carriage to passengers who fail to comply with applicable laws or who fail to present all necessary travel documents.
  5. You can obtain more information about your contract of carriage, and find out how to request a copy, at places where transportation on the carrier is sold. Many carriers also have this information on their websites. When required by applicable law, you have the right to inspect the full text of your contract of carriage at the carrier’s airport and sales offices, and upon request, to receive a copy by mail or other delivery service from each carrier free of charge.
  6. If a carrier sells air transportation services or checks baggage specifying carriage on another carrier, it does so only as agent for the other carrier.

YOU CANNOT TRAVEL IF YOU DO NOT HAVE ALL REQUIRED TRAVEL DOCUMENTS, SUCH AS PASSPORT AND VISA. GOVERNMENTS MAY REQUIRE YOUR CARRIER TO PROVIDE INFORMATION ON OR PERMIT ACCESS TO PASSENGER DATA.

DENIED BOARDING: Airline flights may occasionally be overbooked, which means there is a slight chance that a seat may not be available on a flight for which a passenger has a confirmed reservation. In the event of overbooking, no passengers will be denied a seat until the airline personnel first seek volunteers willing to relinquish their reservations in exchange for compensation determined by the airline. If there are insufficient volunteers, the airline may deny boarding to other passengers according to its specific boarding priority policy. Detailed rules for compensation and each airline’s boarding priorities are available at all airport ticket counters and boarding locations. Some airlines may not apply these consumer protections for travel originating from certain foreign countries, though other consumer protections may be available. Please consult your airline or travel agent for more information.

BAGGAGE: Excess valuation may be declared for certain types of items. Carriers may have specific rules for fragile, valuable, or perishable items; please check with your carrier for details. Checked Baggage: Airlines may offer a free checked baggage allowance, which varies depending on the carrier, class of service, and/or route. Additional charges may apply for checked baggage that exceeds the carrier’s permitted allowance. Cabin (Unchecked) Baggage: Airlines may provide a free cabin baggage allowance, which also varies by carrier, class, route, and/or aircraft type. It is advisable to limit cabin baggage to a minimum. If multiple carriers are involved in your journey, each may have different baggage policies for both checked and cabin baggage. Please check with each carrier for their specific rules.

CHECK-IN TIMES: The departure time listed on your itinerary or receipt is the time the aircraft is scheduled to depart. This time is not the same as the check-in time or the boarding time. Your carrier may refuse to carry you if you do not arrive on time. Check-in times, as advised by your carrier, indicate the latest time passengers can be accepted for travel. Dangerous goods include, but are not limited to, compressed gases, corrosives, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and briefcases with installed alarm devices. Credit Card Chargebacks

You have the right to dispute charges with credit card companies, known as “chargebacks.” If you have any questions regarding a charge on your credit card statement, we strongly encourage you to contact FlyExpert before initiating a chargeback with your credit card company. This allows us the opportunity to address and resolve any questions or concerns you may have about our charges. FlyExpert is committed to working with you to resolve any issues. However, FlyExpert reserves the right to contest any chargeback it deems improper, as detailed below, and may cancel any booking associated with such a chargeback. FlyExpert considers the following chargeback scenarios to be improper and reserves the right to investigate, dispute, and recover costs associated with any such chargeback claims:

  1. Chargebacks resulting from non-refundable bookings in cases where FlyExpert or the airline is unable to provide a refund, regardless of whether the booking was used.
  2. Chargebacks resulting from charges authorized by family members, friends, associates, or other third parties who have direct access to your credit card.
  3. Chargebacks related to the airline’s failure to provide a product or service in a manner consistent with the airline’s description.
  4. Chargebacks arising from force majeure events or other circumstances beyond the control of FlyExpert.
  5. Chargebacks related to services or products that have been partially or fully utilized by you.

To clarify, in accordance with our Privacy Policy, we may use information related to you, including recordings of customer service calls, to dispute chargeback claims. By agreeing to these terms, you unconditionally authorize FLYEXPERT to charge your credit card (or retain funds from your account) for any chargeback processed by the bank related to services or products you have fully or partially used. Furthermore, you unconditionally authorize FLYEXPERT to charge your credit card (or retain funds from your account) a fee of US$100 as a chargeback processing fee. This fee covers the administrative costs of chargeback resolution through our merchant bank for chargebacks initiated by you without merit and subsequently rejected by the bank.

COVID-19 Waiver of Liability

You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest travel supplier requirements, check the supplier’s home page. We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund. If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but we may charge a nonrefundable fee for such services. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy. YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS DESCRIBED ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
